This platform provides public access to its interactive websites, applications, and related services.

These Terms & Conditions, together with our Privacy Policy, govern access to and use of our website, mobile widgets, applications, and all other related services including but not limited to https://www.tnhealthfoundation.org/ and all associated platforms where these Terms & Conditions are displayed.
 

By accessing or using any part of our Services, you agree to be bound by these Terms.

Please read these Terms & Conditions carefully before using our Services. By accessing or using any of our Services (other than to review these Terms for the first time), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, as may be updated or modified from time to time. If you do not agree to these Terms, you are advised not to use or access any of our Services. Any violation of these Terms & Conditions may result in appropriate legal action as permitted under applicable law.

3. Eligibility for CSR Contribution
 

3.1 Compliance & CSR Guidelines

• All contributions must strictly comply with applicable government rules and approvals.

• CSR activities may be carried out only through entities registered with the Ministry of Corporate Affairs, with online updates of requirements aligned to Schedule VII of the Companies Act, 2013.

• Donors must ensure complete transparency and maintain proper documentation for every contribution.

• Donation of contraband or unauthorised items is strictly prohibited; contributions towards vehicles for officials are not permitted.

• Contributions from unregistered entities, projects falling outside approved CSR categories, and any financial transactions lacking clear, traceable documentation must be avoided.
   

3.2 For Companies
 

• Only companies registered under the Companies Act, 2013, that are required or wish to undertake CSR activities under Section 135, are eligible to contribute.

• Contributions must be made only towards listed or approved projects.

• The donor company must upload its CSR policy, certificate of registration, and Board Resolution authorising the contribution.
   

4. Consent to Electronic Disclosures
 

By using the NalamTN platform, you agree to receive communications and disclosures electronically, including:

• Terms and Conditions and legal disclosures

• Privacy Policy updates

• Appointment confirmations and reminders

• Medical reports and notifications

• Billing and payment confirmations

• Important health-related communications

These communications may be sent via email, SMS, or Website notifications. To receive these electronically, you must have access to a computer or smartphone with internet connectivity, and a valid email address or mobile number.
 

5. Online Submission of Requirements
 

• District-specific login credentials will be provided to all districts.

• Requirements from Government Hospitals will be uploaded to the portal, subject to the approval of the respective District Committees.
   

6. Project Proposal and Fund Utilisation
 

• All project proposals must be submitted through the portal.

• நலம்TN reserves the sole right to approve, modify, or reject any project proposal.

• Where required by law, the platform may share relevant information with authorised government agencies or healthcare regulatory authorities.
  
   

7. Refund Policy
 

7.1 How to Request a Refund
 

A donor/company/individual may submit a refund request in writing to the District or State Committee within ten (10) days of the contribution. The request must be sent by email or in person, accompanied by:

• Copy of the transaction ID generated on the NalamTN portal

• Copy of the transaction receipt / bank statement

• Reason for seeking the refund, with supporting documents, if any

• Board Resolution or authorisation letter (for companies)
   

7.2 Processing

• Refunds will be processed within one month of verification.

• Refunds will be credited back through the same payment gateway used for the original contribution.

• No refund will attract any interest.

• Refund eligibility is also subject to the specific policies of the concerned contribution provider or medical facility.
   

7.3 Limited Exceptional Cases for Refund
 

Refunds will be considered by NalamTN only in the following cases:

• Technical or payment error

• Clerical error

7.4 Non-Refundable Scenarios
 

Refunds will not be issued where:

• The request is received after 10 days of the transaction.

• The request is based on a change of mind or a change in the donor company's internal policy.

• Funds are surplus or unspent after project completion — such amounts will be utilised for other approved CSR health projects, as permitted by law.
   

8. Intellectual Property
 

All content available on the platform, including medical articles, images, graphics, videos, software, platform design, and educational materials (collectively, "Service Content"), is the intellectual property of Tamil Nadu Health Foundation NalamTN, its licensors, or content providers. Unauthorized reproduction, distribution, or modification of this content is strictly prohibited.

9. Access and Use
 

While using the platform, users agree not to:

• Violate any applicable laws or healthcare regulations

• Provide false or misleading medical information

• Upload harmful software, viruses, or malicious code

• Attempt unauthorised access to system data

• Misuse medical information or services

• Use automated tools (bots, scrapers) without permission

• Interfere with the proper functioning of the platform

Users must cooperate with the platform in the event of any investigation into misuse or security concerns.
 

10. Data Privacy and Medical Records
 

Medical data and other information collected through the platform will be handled in accordance with our Privacy Policy and applicable data protection laws.
 

11. Miscellaneous
 

• No waiver by either party of any breach or default under these Terms shall be deemed a waiver of any previous or subsequent breach.

• If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions shall continue to remain valid and enforceable.

• These Terms & Conditions, together with the Privacy Policy, constitute the entire agreement between the user and the platform.
   

12. Jurisdiction
 

Any disputes arising from the use of the platform shall first be attempted to be resolved mutually. If unresolved, such disputes shall be subject to the exclusive jurisdiction of the Civil Courts of Chennai, Tamil Nadu, India.
 

13. Legal Disclaimer
 

• This policy is framed in accordance with the Companies Act, 2013 and Government of Tamil Nadu orders on CSR.

• Any dispute shall be subject to the jurisdiction of the courts in Chennai only.

• நலம்TN reserves the right to modify this policy at any time. The updated policy will be displayed on the நலம்TN portal.
